Permits & Compliance

Building permits, mechanical permits, and regulatory compliance status at Woodbury data centers

Overview

Data centers require building permits, mechanical permits for equipment, electrical permits, and (if applicable) air emissions registrations. Woodbury's two IronGate facilities have operating permits but several key regulatory documents are either missing or not publicly available.

Key Issue: Eagan found unpermitted chillers operating before approval, which became grounds for permit denial. Woodbury should verify that all equipment at 401 and 500 has been formally permitted.

Electrical Permit✓ LikelyUnknown2023–2024 (power system upgrade to 6+ MW)Required for operational capacity
Generator/Standby Power Permit? Unknown—UnknownNot found in public records; should be on file if generators are installed
Air Emissions Permit✗ Not found——No MPCA record found for 500 Bielenberg despite 290,000 SF facility and 6 MW operational capacity
Certificate of Occupancy (Data Center Use)✗ Not found——First operational capacity March 2024; no COO for data center use found

The "Mechanical Permit" & "Repairs" Loophole

What Eagan Found

Eagan's interim ordinance included this language:

"No mechanical permit shall be issued for the installation or replacement of cooling, standby power, or fuel storage equipment, other than repairs necessary to maintain existing, lawfully permitted operations at their nameplate rated capacity."

The problem Eagan discovered: An applicant claimed chiller replacements were "routine maintenance" (repairs) rather than expansions. By replacing chillers with higher-capacity units, they could add load without new permits.

How This Could Apply to Woodbury

Scenario 1 (401 Bielenberg): Facility is permitted at 15 MW. To expand to 66 MW, operators claim "chiller replacement" is maintenance, not expansion. New chillers with 66 MW rating replace 15 MW originals. Under vague "repairs" exemption, no new mechanical permit required.

Scenario 2 (500 Bielenberg): Facility is permitted at 6 MW. To expand to 34 MW, claim "generator upgrade" is maintenance. Install higher-capacity generators. No new permit required under "repairs" exemption.

Eagan's Solution: City required permits to specify "nameplate rated capacity." Any equipment replacement must maintain that capacity, not exceed it. Expansion requires new permits.

Woodbury's Mechanical Permit Status

Missing Information:

Finding: Without explicit "nameplate capacity" language in mechanical permits, Woodbury faces the same loophole Eagan found. Expansion could proceed as "repairs" without new permit review.

Eagan's Permit Denial: The Unpermitted Chillers Issue

Eagan's Finding: "The applicant operated chillers without a mechanical permit or interim use permit approval."

Four temporary and eight permanent chillers were operating before approval. This became a grounds for permit denial.

Applying This to Woodbury

Question for City: When did chiller/cooling systems come online at 401 and 500? Were mechanical permits issued before or after equipment installation?

FacilityEquipment TypeInstallation DateMechanical Permit Filed Before?Need to Verify
401 BielenbergChillers (closed-loop cooling)2013 (assumed)UnknownYES — confirm permit predates operation
500 BielenbergChillers (cooling system)2023–2024 (retrofit)UnknownYES — confirm permits filed before March 2024 operational date
Compliance Risk: If cooling systems operated without mechanical permits, Woodbury has the same compliance issue Eagan cited as grounds for denial.

Data Practices Requests to Verify Permits

To verify permit status, submit the following data request to Woodbury City:

"Please provide all building, mechanical, electrical, fire-protection, and equipment permits issued for 401 and 500 Bielenberg Drive since January 1, 2013, including: 1. Permit applications (with dates submitted and approved) 2. Plan sheets and specifications (including nameplate capacity of chillers, generators, power systems) 3. Inspection reports and sign-offs 4. Certificates of occupancy 5. Any permits for equipment replacement, repairs, or upgrades filed since initial approval Please specify the 'nameplate rated capacity' documented in any mechanical permit for each facility."

Expected Response Time: 10–21 days (Minnesota Data Practices Act)

What to Look For

Interim Ordinance Study Recommendation

The interim ordinance should require:

"Before approval of any data center expansion, applicant shall provide to city staff (for public record): 1. Complete history of all building, mechanical, electrical, and equipment permits for the facility 2. Nameplate rated capacity of all chillers, generators, and power systems (as documented in permits) 3. Certification that all equipment is lawfully permitted 4. Any 'repair' permits filed in past 3 years (to detect covert equipment upgrades) 5. A design capacity document signed by engineer stating maximum permitted MW capacity"

What This Means

Key Questions for City Council

1. Permit Status: What building and mechanical permits are on file for 401 and 500 Bielenberg? Please provide permit numbers, dates issued, and nameplate capacity ratings for cooling/power equipment.

2. Timeline Verification: When did chiller and generator systems come online at each facility? Were mechanical permits filed before or after equipment installation?

3. Nameplate Capacity: Do mechanical permits specify the "nameplate rated capacity" of equipment? If not, can this be added to prevent the "repairs" loophole?

4. Air Emissions: Why is 401 Bielenberg listed in MPCA system under "Medtronic" name rather than IronGate or Woodbury Capital LLC? Has an air emissions permit been filed with MPCA for generator(s)?

5. 500 Missing Record: Why does 500 Bielenberg have no air emissions record with MPCA despite being a 290,000 SF facility with 6 MW operational capacity? If generators are installed, why no MPCA registration?

6. Interim Ordinance Provisions: Will the final ordinance require nameplate capacity specifications in all permits and lock them against "repair" expansion loopholes?
